NYC Photo Safari "Get the Picture" Terms of Use

You may use Get the Picture App (hereinafter singly or collectively referred to as “App") and the information herein (hereinafter singly or collectively referred to as "Content") solely for your non-commercial, personal purposes and/or to learn about the products and services provided by New York City Photo Safari, LLC (hereinafter singly or collectively referred to as "NYCPS"). No right, title or interest in any Content is transferred to you. NYCPS retains the full intellectual property rights to all Content. You may not use, copy, distribute, alter, transmit, or derive any other work from any Content obtained from the App.

Copyright
The App and the Content are protected by U.S. and/or foreign copyright laws, and belong to NYCPS and all copyrights and trademarks in the Content are owned by New York City Photo Safari, LLC.

Trademarks
You are prohibited from using any of the marks or logos appearing throughout the APP without permission from NYCPS.

Links to Third-Party Web Sites
Links on the App to third party websites or information are provided for your reference only. These links do not constitute or imply an endorsement, sponsorship, or recommendation by NYCPS. of the third party or their website, or the information contained therein. NYCPS is not responsible or liable for any such website or the content therein. If you use the links to the websites of NYCPS affiliates or service providers, you will leave the App, and will be subject to the terms of use and privacy policy applicable to those web subsequent sites.

New York City Photo Safari, LLC. Does not make any expressed or implied representations, warranties or endorsements with respect to the contents of the App or Content herein. NYCPS disclaims all warranties expressed or implied, including but not limited to fitness for any particular purposes or use. NYCPS does not warrant the functions available on the App will be uninterrupted, timely, secure or error free; or that mistakes in the App or the services will be corrected by NYCPS.

Limitation of Liability
New York City Photo Safari, LLC will not be liable for any damages, including, but not limited to any direct or indirect damages resulting from (a.) the use or inability to use the App or content, (b.) any claim attributable to errors, omissions, or other inaccuracies in the Content (c.) if you are dissatisfied with the App or Content or the Terms of Use, your only remedy is to discontinue using the App. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, some of the above limitations may not apply to you. In these locations, NYCPS's liability is limited and warranties are excluded to the greatest extent permitted by law, but shall not exceed $1 USD.

Miscellaneous
By submitting your personal information on the App you agree to receive emails from NYCPS with information about, but not limited to, upcoming photo tours and photography workshops and other offers that we think may interest you. You will be given the opportunity to unsubscribe on every email that we send.

Indemnification
You understand and agree that you are personally responsible for your behavior on the App. You agree to indemnify, defend and hold harmless New York City Photo Safari, LLC. , and it’s affiliates from and against all claims, losses, expenses, and costs (including, but not limited to, direct, incidental, consequential, and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your use, misuse, or inability to use the App, the Service, or the Content, or any violation by you of this Agreement.
